We, the undersigned citizens and residents of California, ask that the current rules and regulations of the Department of Motor Vehicles be revised so that persons whose license is suspended for a medical reason as the result of a late submission of a Driver’s Medical Evaluation (“DME”) have the suspension set aside once an acceptable DME is provided. By changing the current practice of ending the suspension to one of setting the suspension aside, drivers whose license was suspended for a reason unrelated to their actual health or driving ability will not be subjected to an unfair increase in auto insurance rates.Under this procedure, a driver would be suspended until the DME is provided so that potentially unsafe drivers are off the road. But once a DME is submitted that is deemed acceptable by the DMV, the suspension would be set aside so that an unfounded and unfair increase in insurance rates is not allowed pursuant to Insurance Code §661(a) (2).
